1.0 General

1.1 This site Harry's Liquor.com.au is a shopping website where you can browse, select and order products advertised on the Site (“Products”) from Hassy Investments Pty Ltd. trading as Harry's Liquor (ABN 27 121 289 718).

1.2 Please read the Terms and Conditions before using the site.

2.0 Agreement

2.1 As a condition of using this website, you agree to comply with and be subject to all of the following terms and conditions of use (including our privacy policy).

2.2 We may change these terms and conditions at any time, without notifying you, and such modifications will be effective as soon as they are posted. For future orders, these terms may therefore be different. We recommend reading these terms carefully each time you agree to them during the ordering process. If following any such change you continue to use the Site, then you will be deemed to have accepted those changes or modifications.

3.0 Registration

3.1 Any personal information that you give us will be held and may be used.

3.2 You may not have more than one active account at any one time. You may update your account at any time through the site. There cannot be more than two accounts per billing address.

3.3 Please note that we will use the provided email address to notify you of relevant information, order updates, and the latest offers.

4.0 Purchasing Online

4.1 When purchasing online, you confirm that all details provided when purchasing the liquor are true and correct.

4.2 Proof of age is required when purchasing. It is against the law to sell or supply alcohol to, or obtain alcohol on behalf of, a person under the age of 18 years.

4.3 All prices are in Australian dollars and are inclusive of GST.

4.4 All goods or services are provided in accordance with your rights under Australian Consumer Law.

4.5 Harry's Liquor may make changes to content online at any time and may at times refer to products not available in your area or country. Please contact us at any time for any specific queries. Where a wine vintage may not be available, another vintage may be substituted. All orders are subject to stock being available.

5.0 Liquor Licence

5.1 The NSW Liquor Act 2007 prohibits the sale of liquor to persons under the age of 18 years. When placing an order, you will be asked to confirm your age and supply your date of birth. If you cannot confirm that you are 18 years or older, your order will not be processed.

5.2 Your contract of sale is with Harry's Liquor ABN 27 121 289 718, in accordance with NSW Packaged Liquor Licence Number LIQP770010378, as the liquor is sold from our website by our licensee on behalf of Harry's Liquor ABN 27 121 289 718.

5.3 The sale of liquor from this website is made at our licensed premises attached to the liquor licence number LIQP770010378 at 103 Railway Terrace, Schofields NSW 2762. Accordingly, your offer to purchase is subject to acceptance by the holder of the Liquor Licence, certification and evidence of the purchase being over 18 years of age, the availability of stock and the liquor which is the subject matter of your offer being ascertained, and appropriated at the above-mentioned licensed premises. 

6.0 Delivery

6.1 Delivery rates are calculated at the checkout.

6.2 Orders are generally processed and dispatched on the same business day as the order is placed, or the next business day (excludes public holidays). Please see delivery information for further details on times and locations or email sales@harrysliquor.com.au for any questions relating to delivery.

6.3 Harry's Liquor ensures that all items delivered are in saleable condition. Please contact us immediately to advise of any breakage, or concerns with your delivery at sales@harrysliquor.com.au.

6.4 It is the obligation of the customer to provide the correct delivery address details at the time of ordering. Should you enter an incorrect/insufficient address, we are not obligated to re-send the order to the correct address at our expense. Should a refund be necessary, a full refund of items with less delivery will be provided.

6.5 An acceptable proof of age document must be current and includes;

    1. Driver’s or rider’s license or permit (issued by an Australian State or Territory or any foreign country);
    2. Australian passport or a foreign passport issued by another country;
    3. NSW Photo Card (issued by Roads and Maritime Services NSW);
    4. Proof of age card issued by a public authority of the Commonwealth or of another State or Territory for the purpose of attesting to a person’s identity and age; 
    5. Keypass (over 18) identity card issued by Australia Post; or approved NSW digital driver's license.

6.6 Liquor will not be delivered if;

    1. The person attempting to take delivery:
    2. Does not provide proof of identity and date of birth as required by us, or:
    3. Appears, at our discretion, to be intoxicated or abusive, or
    4. At our discretion, liquor Products may be supplied to a person under the age of 18 years.

6.7 We do not deliver to areas that are classified by the Australian Government as dry zones or restricted areas. Alcohol is banned in these areas outside licensed premises. If your delivery address is located within a restricted area, your order will be placed on hold, and we will contact you via email.

6.8 All products listed in 'Quick Ship' are available for Express Delivery (Within 4 hours).

7.0 Returns

7.1 We offer returns (refunds) in line with your rights under Australian Consumer Law.

7.2 Once an order is shipped, a cancellation cannot be processed. 

7.3 When returning an item for exchange, the new order will not be shipped until the previous order is received.

8.0 Payment

8.1 Orders placed on the website must be paid in full before the postage of the goods.

8.2 Payments made via credit card will not be stored on our servers, however, they may be retained by our payment gateway provider PayPal.

8.3 Orders placed via PayPal must be completed before the postage of goods. A payment confirmation email will be received from PayPal, followed by postage of goods.

8.4 No assurance of held stock will be made in the instance of failed payments.

9.0 Intellectual Property

9.1 This website contains material that is owned by or licensed to us. This material includes but is not limited to, the design, layout, look, appearance, and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

9.2 Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

9.3 Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services, or information available through this website meet your specific requirements.

9.4 All trademarks reproduced on this website, which is not the property of, or licensed to the operator, are acknowledged on the website.

9.5 From time to time, this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).
